Sub : Guidelines for Indefinite Strike - 2

Sir/Madam,

Now that Joint Action Committee of various employees associations under NVS has called on indefinite strike from 1st February,2010 onwards as we have completely been exhausted of all Gandhian and peaceful methods of getting our pension demand fulfilled by the government we shall continue with the same with growing spirit, commitment and determination.

Many letters were sent through members of Parliament, Ministers and other prominent political leaders to the finance Minister, Minister of HRD and commissioner Navodaya Vidyalaya Samiti to implement GPF cum Pension Scheme to all the employees who have joined prior to 1.1.2004. and to implement 10 % special allowance to nonteaching staff of JNVs.The joint Action Committee personally called on Minister of HRD, Finance minister Law Minister, Minister for Parliamentary Affairs and various state ministers and finally Sri Rahul Gandhi,General Secretary AICC to implore on the urgent need to implement GPF cum pension scheme as is being done in other autonomous organizations under govt of India

Knock the doors, the doors will be opened is an old dictum. We believed in this and knocked all the doors, but the resulting are not promising. Everyone is of the opinion that our demand are genuine ,just and fully within the policy of the government of India. Yet, we are left in lurch.

The tender invited by Samiti to submit the biodata of actuaries for calculating the financial liabilities to implement GPF-cum-Pension Scheme raises eyebrows on the following facts :

Ministry of HRD vide their letter dated 10th December addressed to the Commissioner NVS to submit an explanatory note on the need for implementing the GPF-cum Pension scheme and the financial liability was to be submitted on or before 15th December,2009.This was faxed to NVS office on 10th December itself.The pertinent question is why should NVS make an inordinate delay to invite a tender after one month and more so, giving 21 days for submission of their biodata w.e.f 7th January.
Sri.Buddhadev Bhattacharji an actuary from Kolkata had already calculated the financial liability during 2006 and submitted to Mnistry of HRD and the copy of the same is available with NVS.The easiest solution should have been to request the actuary to make necessary modifications on the basis of VI Pay Commission Report so that the present time delay of two or three months could have been avoided.Also this should have cost less expenditure to NVS.
The delay tactics is clearly an indication that on 29th of January NVS would like to state that they have already received the biodata of actuaries and the process is on with a request to JAC to withdraw the strike.
As per the judgement of CAT,Hyderabad Govt of India is supposed to review the pension scheme to the employees who have joined prior to 01.01.2004 within three months from December 2009.This tender is also a method to defend the Samiti rather than considering the welfare of employees.JAC has been asking right from July 2009 to reconsider the issue of pension. If NVS is really interested in the welfare of the employees they should have made all the papers ready and submit a fresh note to the HRD immediately within a week’s time.This shows the least concern of NVS authorities.
When five inter university councils were granted GPF cum pension scheme on 10th July,2009 no financial liability was calculated.Thus for implementing the same as per the policy of the government is there any need to calculate the financial liability ?
Under the above circumstances we are compelled to go for an indefinite strike though unwillingly because that is not the work culture built by us. The compulsion has come from the part of Samiti and the govt of India for having shown a deaf ear to the prayers of JAC.

In continuation to the letter of even No.F-80/JAC/2009-10 dated 7-01-2010 the following additional guidelines are appended below with a request to strictly comply with to ensure that we stand together for a common cause of employees of NVS.

Campaigning in the neighbouring vidylayas by state level JAC will be the immediate task to be undertaken. All the members of staff including principals and vice-principals should be a part of the striking employees.
Keeping the students within the Vidyalaya campus during the period of strike is not in the interest of safety and security of the students. Hence parents should be informed accordingly and send the students home on 31st January,2010.
It is advisable to request the parents to send letters to the Minister of HRD, Finance Minister and Commissioner of NVS to intervene in the matter immediately with a request to settle the matter amicably in the interest of students members of the staff and the organization.(The draft is attached as Annexure 1)
All family members of the employees should immediately be encouraged to send letters the above addressees immediately.( The draft is attached as annexure -2)
Practical examination of Classes X and XII can be attended to only after the government or Samiti settles the issue at the earliest.
As the indefinite strike/mass leave will begin from 1st of February,2010, there is no need to attend JNVST-2010 till the matter is settled.
Kindly remember that the copy of the notice should also be served to the district collector,Member of Parliament and Deputy Commissioner of the respective region with a request to bring the seriousness of the situation to the government
Adequate publicity should be given through newspapers regarding the proposed strike w.e.f 1st February 2010.The copy of newspaper cuttings may be forwarded to Minister of Finance,Minister of HRD and Prime Minister for immediate intervention .
Principals are requested to convene an emergency meeting of staff members,PTC and appraise them of the matter.It has been observed that some principals are not showing the letters to the staff members.Principals Forum is actively with the JAC and hence they should stand with the employees for this purpose and to motivate them.
Staff of every vidyalaya including principals are requested to make sufficient posters, notices regarding the indefinite strike and display and distribute the same among the public. This is to make the public aware of the urgent need of the employees demand. Please remember the fact that even toddy tappers and workers in unorganized sector are eligible for pension whereas the staff members and teachers have to go empty handed after retirement.
It is reiterated once again that students should not be retained in the campus under any circumstances. The migrated students can be attached with the native students and parents for a Home visit during the period of strike. In this context this is to bring to your kind notice that Home visit of migrated students with the native students has been a part of the scheme of NVS in order to foster National Integration as envisaged in the policy document.
Mass leave/indefinite strike does not mean that employees can keep themselves away from the campus. Instead all the staff members should sit infront of the gate on dharna which is to be inaugurated by a Member of Parliament/MLA/any prominent political leader/eminent person etc. Since students are sent home all the employees of the mess should also participate in the dharna on the days of strike.
No one should sign in the attendance register and the system should come to a stand still.
If required on the days of strike the venue can be shifted to the premises of collectorate.
Photographs and the news items should appear in the news paper of national importance as well as local news and the same should be faxed to the commissioner NVS,Minister of HRD,Finance Minister and Prime Minister for immediate information of the concerned authorities.
Participation of every employee in the Vidyalayas, Regional Offices,NLIs and Head Quarters will certainly bring fruits to a large section of employees of NVS.Crying child will only get the milk is an old dictum where as loudly crying child can only get the milk.
National JAC Meeting is proposed to be held on 23rd January 2010 at Pune. Further communication will follow after the meeting.


Kindly go through the above points meticulously and implement. Since we are doing a yeoman service compared to any other set of government employees, we have the right to get GPF cum Pension Scheme implemented for which let us join hands without fear.

Respected sir,
As you are well aware of the fact that employees of Jawahar Navodaya Vidyalayas have decided to launch an indefinite strike in order to press their demand of implementing GPF cum Pension scheme to the employees in service prior to 01/01/2004.
Since their demand is quiet appropriate as per the policy of Government of India, we the parents feel that it is quiet genuine and just.
However since the public examinations are approaching fast, a strike by the teachers and other employees will certainly tell upon the performance of our children in the ensuing examinations.
Hence it is requested that Government should immediately intervene in the matter to avoid a strike situation by accepting their demands immediately in the interest of our children and Navodaya Vidyalaya Samiti.

Respected Sir,

With due respect, I humbly submit the following lines for your kind consideration.

1. Jawahar Navodaya Vidyalayas (JNVs), as a dream of late Shri Rajiv Gandhi need no introduction to your kind self. They exist in 593 districts in the country as on date and have a staff strength more than 24,000 employees working day and night in a residential set up in rural areas to provide modern quality education to around 2.25 lakhs of children, predominantly hailing from rural areas.

2. JNVs are the counterparts of Kendriya Vidyalayas with basic difference of their location and working hours. While Kendriya Vidyalayas are located in urban areas and have working hours of 8 hrs per day for catering to the needs of urban children whose parents are already well settled mostly in Govt service, JNVs take care of the first generation learners of rural areas in residential set up residing in the campus itself and working round the clock without fixed duty hours and most of the times foregoing their weekly offs and holidays.

3. Yet, the employees of Navodaya Vidyalaya Samiti, who have joined the organization prior to 01.01.2004 have not been granted GPF-cum-Pension Scheme as per CCS Pension Rules-1972, while their counterparts in all other organizations under the Ministry of HRD are enjoying the same without even putting half of the efforts of the employees of Navodaya Vidyalayas.

4. The following committees have strongly recommended grant of CCS Pension Scheme-1972 to those employees of NAVODAYA VIDYALAYA SAMITI who joined prior to 2004, at par with their counterparts in KVS and other educational organizations under Ministry of HRD.

(a) Shri YN Chaturvedi Committee
(b) The Parliamentary Standing Committee No. 154 which presented its report in the Lok Sabha on 02.02.2005 and in Rajya Sabha on 03.03.2005.
(c) The Parliamentary Standing Committee No. 184 which presented its report in the Lok Sabha and Rajya Sabha on 30.11.2006.
(d) The Parliamentary Standing Committee No. 198

5. Sir, may I kindly bring to your kind notice that the recommendations of the above Committees are pending implementation due to the biased attitude of bureaucrats in the Ministries of HRD and Finance. Many employees from NAVODAYA VIDYALAYA SAMITI are retiring every month in considerable numbers only to be dependent on their wards after dedicating their lives for the fulfillment of objectives of Govt. of India through NAVODAYA VIDYALAYA SAMITI.

6. It is understood that the employees of NAVODAYA VIDYALAYA SAMITI have ran from pillar to post in Delhi for gathering support for their genuine demand of GPF-cum-Pension Scheme.

7. I now very humbly request your supreme authorities to personally intervene into this matter and ensure that justice is delivered to 13,500 odd employees of NAVODAYA VIDYALAYA SAMITI who joined prior to 2004 by way of bestowing GPF-cum-Pension Scheme.
