Sir/ Madam,
1. As per the invitation of Joint Commissioner NVS New Delhi, vide letter no:18-1/2009-NVS(admin) Dated 27-11-2009 the JAC attended the meeting at 11.30 am on 30th November 2009 in the chamber of Joint Commissioner(admin). Sri Alok Verma JC (admin) impressed on the JAC members to approach the Finance Ministry with regard to GPF cum Pension Scheme. He further expressed that he doesn’t advocate for strike. However the JAC has informed him that all out efforts will be made to press our demands of introducing GPF cum Pension scheme and 10% special allowance to non teaching staff with the HRD Ministry and Finance Ministry. In the mean time, he had informed that for 2 or 3 categories of non teaching staff, 10% special allowances have already been agreed to by the MHRD. The delegation of JAC insisted on this issue that all the non teaching staff should be granted special allowance as everyone has serious involvement in managing the boarding and lodging aspects of the students irrespective of the working days or holidays.
Further the JAC has informed the Joint Commissioner (admn.) that in case the Govt. and NVS do not accede to our genuine and just demands, the staff will be opting for an indefinite strike on any day after 25th of January, 2010.
Further,Joint Commissioner had arranged another meeting with Commissioner NVS in the afternoon session on 30thNovember.
A delegation of 5 members of JAC called on Sri. Amit Khaire,Joint Secretary and Commissioner NVS in the afternoon of 30th November in the presence of Joint Commissioner (admin).
It is a matter of great happiness that Commissioner was fully sympathetic with the members of the staff of NVS and he expressed in emphatic terms that the demands are absolutely genuine and just. He informed that HRD ministry is favourable to the employees demand and the JAC may have to approach the Finance Ministry for getting the same approved. He also expressed that he would implore on the Ministry that the matter is of very serious nature and will be out of proportion unless a positive and urgent decision is taken by the Govt. with regard to implementation of GPF cum Pension scheme. He has further assured that the case of all the non teaching staff will be taken up for the grant of 10% special allowance as is extended to the teaching staff. Commissioner continued to say that as a Joint Secretary in the Ministry he would continue to support for the cause of employees of NVS.
The JAC members thanked the Commissioner and Joint Commissioner for their support and strength to the genuine demands of employees.
2. Delegation of JAC made a very serious attempt to meet those dignitaries involved in policy decision making.
On 30th morning a delegation met Sri. Pawan Kumar Bensal
Ministry of Parliamentary Affairs. He assured all support and strength to the employees of NVS. He had already represented the matter to MHRM.
On 1st December, 2009 a delegation of JAC had met Sri. Kapil Sibalji Minister of HRD regarding our demands. He said he is very much in favour of implementing our demands, but the Finance Ministry has to agree for it. While discussion was in progress the Hon’ble Minister expressed the view that the cut off date is problem for which we mention that when it can be extended to other institutions like inter university councils, why not for NVS. On this reference he mentioned that not only cut off date but also the same (GPF cum Pension) is extended to those who had opted for the same. In this context we have made it clear that no option was offered by NVS to the employees in this regard. Hence Ministry can give one opportunity for us to opt into GPF Scheme.

He further expressed that the JAC will have to approach the Finance Ministry though MHRD is agreeable for our demands. We thank the Minister for his good gesture.
3. Two separate delegations had called on Sri. Pranab Mukherjee, Finance Minister on 2nd December,one in the forenoon and another in the afternoon. Having listened patiently to our issues he had raised only one question regarding the stand of our department. We expressed that our department is favorable to the introduction of GPF cum Pension scheme and what is essentially required is the approval of Finance Ministry.
4. The delegations also met Secretary MHRD, Sri. Khutia,Joint Secratry MHRD and explained the necessity to take up the matter with Finance department. Both Secretary and Joint Secretary expressed that they are fully convinced with the issues and a favorable note is prepared for the approval of Finance department.
5. Subsequently the delegation of JAC met Ms. Mamtha Banerjee, Hon’ble Minister for Railways, Sri. L K Advaniji, Leader of Opposition in Lok Sabha ,Smt.Sushama Swaraj M P , Sri. Pradeep Kumar Jain Adithya, State Minister for Rural Development ,
All the above dignitaries have expressed full support to the cause of employees of NVS and agreed to represent the matter to Finance Minister and Minister of HRD.
6. In the meantime, our former Director Sri. K S Sharmaji also had a dialogue with Smt. Sushma Nath, Secretary Finance (expenditure) and impressed on her the seriousness of the issue.
7. The delegation had also made a very serious attempt to meet many member of Parliaments and procured letters and handed over the same to the respective Ministries.
It is our pleasure to thank all the members of JAC for having
taken trouble to remain at Delhi for this purpose and impressed many top officials and Ministers to achieve our demands.
However it is absolutely necessary in the present context that continued mobilization while keeping the urgency of the matter every member of NVS should approach more number of Ministers, Members of Parliament in order to build pressure on the Ministries to get our goal materialized.

Decisions taken:
1. The committee felt that Govt. should be given some more time in order to settle our issues. Hence it has been decided unanimously that in case Govt. and Navodaya Vidyalaya Samiti do not implement the demands of introducing GPF-cum-Pension scheme and the extension of 10% special allowance to all the non teaching staff, employees will go for an indefinite strike on any day after 25th January 2010. The proposed date is 1st February 2010.
2. A notice should be given to the Ministry and Navodaya Vidyalaya Samiti regarding the indefinite strike by 25th December 2009.
3. In the mean time it was also decided to meet as many Ministers and MPs to the extend possible by JAC members and request them to personally take up the issues before the Govt. For this purpose few JAC members were asked to remain at Delhi for a period of 4 to 5 days during the current Parliament session.
4. As per the invitation of Joint Commissioner (Admin) of NVS it has been decided to meet him and the Commissioner on 30th November 2009 and categorically to inform samiti that there is no question of withdrawal from the indefinite strike.
5. After elaborate discussions it was decided that all communications on behalf of JAC will be carried out only from one point and Sri. V L Balasubramanian President ,Principals Forum has been authorized to make communications on behalf of JAC.
6. The regional/State Joint action Committee should be constituted immediately and the first meeting should be completed by 25th December at the regional/State level. The existing members at the National Level should take initiative for the same in case the state level/Regional level meeting are not carries out yet.

Sub.: Meeting with two members of the Joint Action Committee.

Sir,

It is learnt that Sh.Alok Verma, IFS, Joint Commissioner(Admn), NS(HQ), New Delhi called upon two members viz. Sh.Yogender Sharma and Sh.Gajender Yadav of Joint Action Committee(JAC) on 25.11.2009 and directed them to attend his office on 26.11.2009. It is further learnt that on the said day he first tried to pressurize them and then discussed regarding the activities of the Joint Action Committee.

This practice being adopted by the management is a clear-cut violation of the established norms of the relationship between the staff associations and management and a clear-cut attempt of “Divide & Rule” which is not at all appreciable. All the notices being issued to the management regarding the demands and activities of the Joint Action Committee are being decided by the all members of JAC which comprises of different associations. All memorandums and notices are being signed and sent to the different authorities by the executive members of the JAC i.e. President and Secretaries. Calling the persons who have not signed the memorandums and notices and holding discussions with them, trying to exert pressure is undemocratic and unwarranted because such decisions will neither be accepted nor the JAC will withdraw its decisions.
Sir, the agony of Navodaya Vidyalaya Employees who have to retire empty handed will not be understood by Sri. Alok Vermaji who is assured of social and family security through 1972 pension scheme.
It is, therefore, requested to advice Mr.Alok Verma, IFS, JC(Admn.) to kindly refrain from such undemocratic practices. If management is interested to hold any discussions regarding the demands of the employees it should address the Executive Members of the JAC and hold meetings where atleast 2/3 majority of the members of the Jonit Action Committee as a whole attends such meetings. The JAC is holding its meeting in Delhi on 29.11.2009 and the decision taken for further course of action for fulfilling the legitimate demands of the NVS employees will be communicated to the management as well as the Govt.

PRESS RELEASE

The employees of Jawahar Navodaya Vidyalayas across the country and the regional offices of Navdaya Vidyalaya samiti have gone on one day token strike today demanding GPF cum Pension to all employeeswho have joined before 01.01.2004 and 10 % special allowance to non-teaching staff. The issue of pension has been remaining unresolved for the past two decades.
Reports from all over the country reveals that the strike is total and peaceful. About 20,000 employees have participated in the token strike. Employees have taken up processions and the meetings held in respective districts were addressed by local MPs,MLAs or other Service association leaders.

This token strike is part of the ongoing efforts to get GPF cum pension implemented. Earlier the employees of Navodaya Vidyalayas and regional offices of NVS had observed Black badge protest week from November 2 to 7 and a massive rally was staged in New Delhi on 9th November,2009. The rally was attended by over five thousand employees from across the country.

Though Jawahar Navodaya Vidyalayas are Central Government Institutions established as per the New Policy on Education 1985 under the Ministry of Human Resource Development the administrative body,Navodaya Vidyalaya Samiti initially opted for CPF scheme which is meant for re-employed staff or staff on contract and chose to continue the same till date. As per the CCS rules Navodaya Vidyalayas employees are eligible for CCS Pension(1972) as the department receives 100 % grant in aid from the Central Government.

154th,184th and 198th Department related Parliamentary standing Committees on HRD have strongly recommended the government to implement pension scheme to the employees of Navodaya Samiti. Many sister institutions like National open school(NIOS), Kendriya Vidyalayas ,Sainik schools, Tibetan Central school who have less working hours compared to teaching and non-teaching staff of Jawahar Navodaya Vidyalayas are granted GPF cum Pension scheme.The IV pay commission had given a one-time option to all central government institutions to switch over to pension scheme from CPF scheme. Accordingly several institutions have done so, yet NVS chose to continue CPF scheme without the consent of its own employees.


Many representations were given during the last 20 years but it has not brought any fruits. Now Novodaya Vidyalaya samiti has introduced new pension scheme to all the employees who have joined right from the inception where as even as per the Govt. of India’s instructions the new pension scheme is not applicable to those who have joined prior to 01/01/2004. The legitimate right of the employees who have joined prior to 01/01/2004,GPF Cum Pension Scheme, has been insensitively denied.

The Chief Vigilance Officer of Ministry of HRD had instructed Navodaya Vidyalaya Samiti to implement pension scheme and intimate positively on or before 31.08.1995.The date was extended to 16.10.1995 since NVS did not comply with. However NVS stood indifferent.

In an exclusive meeting for IITs,IIMs and NVS called by the Board of Secondary and Higher Education ,these organizations were asked to implement pension and furnish report positively NVS failed to act in favour while IITs and IIMs took immediate steps to implement CCS pension to their employees and ansure social security of their staff in their post retirement years.

The employees of Jawahar Navodaya Vidyalayas are bound to work even after the normal schooling hours daily and also on Sundays and holidays taking care of the activities of the students under curricular and co-curicular activities being residential in nature. These members of staff are also responsible for the safety and security of 560 students or so in each Vidyalaya spread over 576 school situated in rural areas one in each district of India.

Today’s token strike has sent a strong message to NVS and the Government that the employees are strongly resolved to get on with indefinite strike from the first week of December if no positive steps are taken to alleviate the problems of the staff who work round the clock for uplift of talented rural children which was a great dream of the former Prime Minister,Sri.Rajiv Gandhi.

Sir,
Arise! Arise! A tidal wave is coming ! The token Strike of employees of Jawahar Navodaya Vidyalayas and Navodaya Vidyalaya Samiti on 16th November 2009. Now onwards there is no time to look back. There is also no time to care for name or fame..
Let us ensure the participation of all the employees in a highly difficult task of bringing all the categories of employees under one umbrella to project our genuine and legitimate demand of GPF-cum-Pension scheme.
No great work can be achieved by humbug. It is through love, a passion for truth and tremendous energy that all undertakings are accomplished. Therefore let us manifest our courage in a very important task of organizing the one day token strike on 16th November 2009.
It is only through sacrifices that India achieved freedom. Let us sacrifice one day’s salary and demonstrate our strength of mind and commitment to achieve our goal.
There are some principals who have reservations to some extend regarding participation in the proposed strike. Can any work of quality be expected from men of little hearts.—Nothing in the World. This is what Swami Vivekananda says.
We must have iron will if we would cross the ocean. We must also be equally strong enough to pierce mountains. Purity of thought, word and deed, patience and perseverance will overcome all obstacles.
The brave alone can afford to be sincere. Let us stamp out the negative spirit and fill your heart with optimism.

The D days is nearing. Show your vigour, enthusiasm and zeal.

As all of you know very well that the Joint Action Committe of various forum and associations has given a notice to the Govt. for holding one day token strike on 16/11/2009 after having performed
peaceful activities like Hunger Work Day on Teachers day, wearing black badges from 2nd to 7th November and mass rally at Delhi on 9th November in order to press our genuine and legitimate demand of introducing GPF-cum-Pension Scheme to all the employees of NVS who have joined prior to 01/01/2004.The above activities were undertaken successfully with the motivation provided by Principals under the banner of Principals forum and the JAC.
The Mass Rally at Jantar Mandir was a successful programme with the participation of around 6000 employees from JNVs & egional offices. In order to achieve success people will have to sacrifice. Work while you have the light. You are responsible for the talent bestowed on you by almighty. As a leader of the team we should equally be conscious of our rights and responsibilities. Hence to make the token strike a success the following guidelines are issued in order to inspire the colleagues and to look into the minimum responsibilities.
1. Kindly act according to the instructions of JAC vide letter dated 11/11/2009 and intimate the District Magistrate/District Collector regarding the strike along with the letter of notice issued by JAC to MHRD and Commissioner on 6th October 2009.
2. All Principals & Vice Principals will be on strike. However they may make previous arrangements to ensure that students are provided with food from the mess with the help of daily wage workers. This arrangement also should be discussed with CA and cook.
3. Safety security aspects of students may be entrusted with contract teachers. However unofficially Principals will be monitoring the same as we are responsible officers.
4. Neither we will be applying for leave nor will we be signing in the attendance register.
5. If possible charge of the principal could also be given for a day to any probationer (either a teacher or in the office) so that the one who is working is not disrupted and any immediate action to be taken regarding safety and security of students can be taken up by them officially where as unofficially we have to support them to maintain safety and security.
6. We are not sending the students home on account of token strike where as in case of indefinite strike only we will be sending the students home for which detailed instructions will follow in due course.
7. As suggested in the JAC letter dated 11/11/2009 Principals are requested to take
initiative to give wide publicity through mass media regarding the demand of GPF-
cum-Pension scheme to the employees who have joined prior to 01/01/2004 and 10%
special allowance to non teaching staff.
8. Copies of representation to be handed over to Member of Parliament should also be
signed by Principals.
9. In case of any panel inspection is arranged on 16/11/2009, kindly request the DCs to
postpone it for some other days.
However it is the personal request of JAC and the Principals forum to make the one day token strike a grand success.

The Joint action Committee of employees associations of Jawahar Navodaya Vidyalayas and Navodaya Vidyalaya Samiti, in its meeting held at Chandigarh on 1st October 2009, has decided the following in order to draw the attention of the Govt. of India for the dare necessity to introduce GPF Cum Pension scheme under CCS Pension rules-1972 and 10% special allowance to the non teaching staff.
1. To observe 2nd November to 7th November as Black badge Days to express our resentments, by all the employees of 576 Jawahar Navodaya Vidyalayas,Regional Offices and Head Quarters office of NVS.
2. A mass rally will be held at Janthar Mandir,New Delhi on 9th November 2009.
3. A Token Strike will be held on 16th November 2009 in all the 576 Vidyalayas, Regional Offices and Head Quarters office of NVS by all the employees including Officers & Principals.
Scheme of Jawahar Navodaya Vidyalayas

The scheme for the establishment of Jawahar navodaya
Vidyalayas (JNVs) was approved by Union Cabinet in August1985 to give shape to the vision of the then Prime Minister Sri.Rajiv Gandhi to have a residential school system for the talented children, predominantly belonging to rural areas. The Navodaya Vidyalaya Samiti (NVS) was established as an autonomous body under the administrative control of Dept. of Secondary and Higher education, Ministry of Human Resource Development. JNVs are fully residential, co-educational institutions providing free education including boarding and lodging, textbooks, uniforms etc. up to the senior secondary stage. Thus Jawahar Navodaya Vidyalayas are addressing the needs of talented rural children of India who may otherwise be deprived of quality education. At present there are 576 Jawahar Navodaya Vidyalayas, one in each district across the country except in Tamil Nadu.
Though the Govt. of India has approved the extension of pay structure of Central Govt. employees to the teaching and non teaching staff of JNVs, when it comes to the question of implementation of GPF Cum Pension Scheme to the employees as per 1972 CCS (pension) rules in spite of repeated requests during the last 2 decades, the same has not been extended. The Navodaya Vidyalaya Samiti has also adopted Govt. of India rules and regulations on service matters for its employees mutantis- mutandis vide order no: F6-1/92-NVS(Admin) dated 30/03/1992 and also brought these employees under the purview of Central Administrative Tribunal.
Many representations were given during the last 20 years but it has not brought any fruits. Now Novodaya Vidyalaya samiti has introduced new pension scheme to all the employees who have joined right from the inception where as even as per the Govt. of India’s instructions the new pension scheme is not applicable to those who have joined prior to 01/01/2004. The legitimate right of the employees who have joined prior to 01/01/2004 is GPF Cum Pension Scheme.
When a delegation of Joint action Committee (JAC) met Sri. Kapil Sibalji Minister of Human Resource Development on 10 August 2009, he had promised to examine the rational behind the issue. Yet no positive outcome has been found.
Employees of Jawahar Navodaya Vidyalays across the country observed a ‘Hunger Work Day’ on 5th September 2009 in order to bring our resentments in the notice of NVS and Govt. of India.

Rational behind demanding GPF cum Pension scheme for the employees
of Navodaya Vidyalaya Samiti who have joined prior to 01-01-2004.

1. Jawahar Navodaya Vidyalayas were started in 1985.
2. Initially employees were taken on deputation from various pensionable departments like Kendriya Vidyalaya Sangathan, Sainik school, State Govt. Institutions, different Departments and from various Ministries.
3. When CPF scheme was introduced in 1991, employees were not consulted with.
4. During 1995 Ministry of HRD had written thrice to the then Director of Navodaya Vidyalaya samiti to introduce provisions similar to CCS pension rules 1972 as it facilitate imposing of penalty on its employees for the act of commissions and omissions committed during their service period (refer letter Do no 8F43/95-UT-II dated 31st August 1995 of Deputy Secretary, letter Do no. C33011/10/81-vig dated 17 July 1995 of Joint Secretary and Chief Vigilance Officer, MHRD Dept.of Education, Do letter no.C33011/10/81-vig dated 10th October 1995 of Under Secretary Vigilance Section of MHRD reminding again to furnish the action taken report on or before 16th October 1995) .Inspiteof these three letters issued by MHRD no action was taken by Navodaya Vidyalaya Samiti to implement GPF cum Pension Scheme to its employees.
Are the employees at fault for not taking up necessary steps by the then administrators of NVS?
5. Extract of General Financial rules of Govt. of India rule 149(4)(IV) states as follows ‘ All Autonomous Bodies or Grantee Institutions which receive more that 50 % of their recurring expenditure in the form of Grant-in-aid should formulate terms and conditions of service of their employees so that by and large they are broadly comparable to those applicable to similar categories of employees in Central Government.’ Since NVS is provided 100% grant-in- aid, by Ministry of Human Resources development, the employees are eligible for pensionary benefits as available to employees of similarly placed organizations like, Kendriya Vidyalayas, Central Tibetan Schools, NCERT, CBSE and institutions under UGC.
6. Relevant portion of extract from IV Pay Commission report para 9.8 reveals that in so far as CPF beneficiaries in service are concerned it is recommended that they should be deemed to have come over to the Pension scheme unless they specifically opt out to continue under CPF Scheme. The Ministry of Personal Public Grievences & Pension vide office memorandum no.4-1/87 P1C1 dated 01/05/1987 conveyd the acceptance of recommendations of 4th pay commission and allowed all the central Govt. employees and employees of Central Autonomous Bodies to change over from CPF Scheme to Pension Scheme. However this option was not extended to the employees of NVS where as the same was extended to the departments like IITs and IIMs.
7. Many institutions like National open school(NIOS), Kendriya Vidyalayas ,Sainik schools, Tibetan Central school who have less working hours compared to teaching and non-teaching staff of Jawahar Navodaya Vidyalayas are granted GPF cum Pension scheme.
8. The employees of Jawahar Navodaya Vidyalayas are bound to work even after the normal schooling hours daily and also on Sundays and holidays taking care of the activities of the students under curricular and co-curicular activities being residential in nature. These members of staff are also responsible for the safety and security of 560 students in each Vidyalaya spread over 576 school situated in rural areas one in each district of India.
9. Organizations like Konkan railways, IITs, IIMS, Punjab University have been granted GPF cum Pension schemes to those employees who have joined prior to 01-01-2004.
10. The review committee set up by Ministry of HRD under the chairmanship of Y N Chadurvedi on the functioning of JNVs inter-alia recommended grant of CCS pension rules 1972 to the staff of Navodaya Vidyalaya samiti.
11. The Department Related standing committees on HRD, under the chairmanship of Shri. Vayalar Ravi, MP(Presently Minister of Overseas Indian affairs) in its 154th report presented the Rajya sabha on 3rd March 2005 and in Lok sabha on 2nd March 2005 has strongly recommended to extend pensionary benefits as it has been done to Kendriya Vidyalayas.
12. The departmental Related Standing Committee on HRD in its 184th report on Navodaya Vidyalaya samiti tabled on both Rajya sabha and Lok sabha on 30th November 2006 reteriated the implementation of pensionary benefits to the employees of NVs.
13. The 198th report on Department Related Standing Committee also has strongly recommended the Govt. to introduce pension scheme on the same lines as being extended to Kendriya Vidyalayas.
14. Your kind attention is also drawn to the letter no. F5-7/98-UT-2 dated 25th August 2004 addressed to the commissioner NVS New Delhi along with a copy of clarification from Ministry of Finance ,Department of Economic Affairs ECB and PR Division clarifying that the New Pension scheme can be introduced as a replacement to the old GPF cum Pension scheme. Conversely speaking having introduced the new pension scheme to employees of Navodaya Vidyalaya Samiti, Govt. has accepted in Principle that GPF cum Pension scheme should be bestowed with.
15. In the recent order of Ministry of HRD vide DO no.F4-26/97-UJ (A) dated 10th July 2009 issued by Director of (Higher Education) has decided to agree to allow GPF cum Pension scheme to the employees of 5 inter University Councils including National Assessment and Accreditation Council who have joined prior to 01-01-2004 in the respective departments and the expenditure on this account will be borne by UGC.
16. The above facts clearly justifies the demand of introducing GPF cum Pension scheme to the employees of Jawahar Navodaya Vidyalayas and Navodaya Vidyalaya samiti who relentlessly work day and night to mould the future mentors of this country for decades together and participate in the Nation building process.
It is under the above circumstances that the issue was raised through various Members of Parliament in the notice ofMinister of HRD and Finance Minister and authorities of Navodaya
Vidyalaya Samiti for the implementation of GPF Cum Pension scheme to the employees.
Can employees of any Central Government organization wait for more than 2 decades to get the legitimate right of GPF Cum Pension scheme? The above circumstances have forced the employees to adopt for organizing the following to express the frustration.
1. Observing ‘Black badge days’ from 2nd to 7th November 2009.
2. Mass rally at Delhi on 9th November 2009 .
3. A ‘token strike’ on 16th November 2009.
The Joint Action Committee feels that the Navodaya Vidyalaya Samiti & Govt. of India will not drag us to a strike situation as the employees are asking only for settling the issue of social security of the employees after retirement in spite of the fact that the employees of these residential schools work round the clock in taking care of safety, security, education and reconstituting the personality of students even on Sundays and holidays.

This is to inform your good offices that Joint Action Committee of various associations of Navodaya Vidyalaya samiti has given a notice vide letter referred above for holding a mass rally on 9th November 2009 at Jantar Mandir by the employees of Navodaya Vidyalaya Samiti and the employees of 576 Jawahar Navodaya Vidyalayas spread over various districts to mark their protest on the issue of non-implementation of GPF cum pension scheme to the employees.
It is proposed to assemble at Jantar mandir by around 9 a.m. It is expected that around 2000 employees from various parts of the country will be assembling for this purpose.
We register our protest for the non implementation of GPF cum Pension scheme for those employees who have been working for more than 2 decades to provide quality education to students predominantly belonging to rural areas.
We believe in Gandhian method of registering our resentment and thus the meeting and the procession will be highly peaceful, fully obeying the rules and regulations.

Sub : Grant of residential allowance to all Non-teaching staff working at JNVs at par with the Teaching Staff – reg.

We may kindly be permitted to bring to your attention the issue of non-teaching staff working at Vidyalaya level in JNVs under NVS for immediate redressal. The Hon’ble Commissioner NVS New Delhi vide his letter : F.No:20-1/2008-NVS(Estt-II) dated 16-10-2008 has proposed grant of residential allowance @10% to all the members of staff working at JNVs in consonance with the assurances given by Hon’ble Commissioner, NVS and other authorities from time to time when the grievances of the staff were brought to their notice through memoranda, Conventions and personal meetings etc., in the light of the additional burden of duties and longer hours of duties cast on the staff of JNVs in the residential set up when compared to day schools.

In the same context we seek to bring to your notice that the then Hon’ble Commissioner, NVS had represented the issues of the staff of the JNVs to the VI CPC, enumerating therein the justification for grant of higher pay scales, residential allowance, rural area allowances, children education allowance and teaching allowance besides grant of CCS Pension 1972 to the staff.

At the backdrop of the above representations the VI CPC has also considered the problems and recommended for grant of residential allowance to the staff working in JNVs at vidyalaya level.

The Ministry of HRD has approved grant of residential allowance only to the teaching staff and ignored the meritorious services rendered by the non-teaching staff of the Vidyalayas. The non-teaching staff of JNVs from Sweeper and Mess Helper to Office Superintendent work for more than 11 hours per day for entire 7 days week, thus have played pivotal role in successful performance of JNVs which has been clearly explained in the letter addressed by the Hon’ble Commissioner, NVS, New Delhi dated 29-12-2006 to the VI CPC. The All India Jawahar Navodaya Vidyalayas Principals’ Forum has also recommended the issue enumerating the paramount importance of all Non-Teaching staff working at Vidyalaya level and their duties & responsibilities in the vidyalaya campus round the clock.

We would further like to bring your favourable attention that the non-teaching staff of JNVs are compelled to stay in the JNV campus along with the teaching staff and share all the hardships together with other staff. The non-teaching staff are foregoing HRA and in addition paying license fee for the free quarters allotted to them. They are working even on public holidays and festivals and extending support to the Vidyalayas. Thus, their services cannot be undermined and, hence, are to be rewarded.

Therefore, we humbly request you to reexamine the issue of extending 10% special allowance to the non-teaching staff and issue necessary orders and oblige.

3) F No: 125-8/2003-04/KVS( Budget) dt 09/09/2009 of Kendriya Vidyalaya Sangathan, New Delhi extending the benefit of the orders referred under (1) and (2) to all the eligible employees of KVS as per the Govt of India orders including teaching staff.
4) Letter no: 6-22/2001-02/NVS(F&A) dt 08/10/2009 of NVS ,New Delhi extending the benefits of order no: 1 & 2 to only non-teaching staff of NVS .

Respected Sir,
Kindly refer to the orders cited above regarding extension of Grant of NPL Bonus to the Central Government employees and employees of autonomous organization fully or partially funded by Govt. of India.
In this connection the following facts are submitted for necessary action at your end.
NVS vide order (4) referred above has extended the benefit of bonus only to non-teaching staff of samiti.
KVS vide order (3) referred above has extended the benefit of bonus to all the employees as per the eligibility spelt out by the Govt.
When teachers of Kendriya Vidyalayas are extended the benefit of Bonus, it is beyond the comprehension of any body, why the same benefit is not extended to teachers of NVS.
The last para of orders of NVS extending the benefit of Bonus for the year 2008-09 to the non-teaching staff, states that the matter is referred to the Ministry of HRD for clarifications.
Sir, this is an example of discriminatory approach of NVS officers where as KVS implements the orders with a straight forward interpretation. There is an attitudinal problem with our officers in NVS Headquarters. Whenever there is a benefit for employees, the same is sabotaged by delay tactics. The following are the examples.
a) As per the recommendations of 6th pay Commission, Group D employees, who have passed class X are to be granted the next higher scale, which has been implemented by KVS where as NVS has not done the same( Refer orders of 6th pay Commission and KVS letter no:FNo:F1108K-4/2003-KVSHQ(Admin) dt 21/11/2008).
b) When 5th pay Commission recommended to double the special allowance of 150 /- granted to the principals, the same was not taken up by NVS for implementation.
c) Most of the teachers who have completed 16 to 18 yrs of service in Hyderabad Region didn’t get the benefit of senior scale to be given after completion of 12 years of service as per 5th pay commission reports. The same is extended to all the teachers in other regions where as the case of Hyderabad region has been referred to the Ministry is the version of NVS Headquarters office. When teachers have completed two 21 days in service programs and 12 yrs of service what stops from NVS to grant the senior scale is a mystery.
If the special allowance of 10% granted to teachers of NVS by 6th Pay Commission is a point of doubt for grant of Bonus to teaching staff. We should like to implore on your good self that this special allowance is not an incentive and any interpretation of the same within the purview of incentive is not only misinterpretation and will not hold good in front of Law.
As per the orders (1) & (2) above all the non gazetted group B employees are entitled to receive the NPL Bonus where as section officers whose grade pay is Rs 4200(similar to that of OS) are also entitled for bonus. All the more no employee of group B cadre in an autonomous organization under Govt. of India is holding the gazetted post, they aught to be considered as non gazetted for whom orders (1) & (2) are applicable.

Sir, the intention of this letter is to request your good self kindly to examine the grant of Bonus to teachers and all group B employees of samiti and issue necessary orders urgently as it has been done by KVS authorities.

Sub : Decision of Staff to abstain from exercising option for New Pension Scheme

Respected Sir,

The Joint Action Committee comprising All India Jawahar Navodaya Vidyalaya Principals Forum, All India Navodaya Vidyalaya Staff Association,All India Navodaya Vidyalaya Samiti Staff Welfare Association & All Inidia Navodaya Vidyalaya Catering Assistants Association has unanimously decided at the JAC meeting held in Chandigargh on 1st October,2009 that all the staff who joined before 1.01.2004 shall invariably abstain from exercising option for New Pension Scheme on the following grounds :

1. Since NVS was established more than 2 decades back,having been accepted all CCS rules mutantis mutandis and derive 100% garant in aid from the Central Government the staff of NVS are legitimately eligible for the GPF cum Pension Scheme.
2. The government had given several chances to NVS to switch over from CPF to Pension Scheme whereas NVS did’nt take appropriate action to communicate the same to employees for switching over thereby the CCS Pension Rules 1972 was not made applicable to the employees.
3. It was without the consent of the employees NVS had opted for CPF instead of pension scheme.
4. Several Parliamentary Standing Committees had strongly recommended the old pension scheme to us and questioned the rationale behind in continuing CPF.
5. When the sister concern likeKVS,Sianik schools,Central Tibetan schools,National Open Schools are entitled for the old pension scheme there is no rationale behind opting for NPS for NVS staff.
6. The pension rule states that GPF Cum Pension Scheme is applicable to those who joined in service prior to 01.01.2004 and not for those who joined on or after 01.01.2004 thus the present dictum is violation of the basic tenet.

7. The NPS does not guarantee gratuity to the employees as such the staff will suffer grave financial loss on retirement
8. The NPS does not clearly and definitively spell out the benefits an employee will get in case of death or disability occurs before retirement,
9. The NPS provides only 20% of the acrued amount to a person who happens to retire before 60 years of age,thus not guaranteeing pension for a minimum service period.
Furthermore the staff who joined NVS on or after 01.01.2004 have also decided to keep away from opting for the NPS as NVS has given a provision that all those joined on or before 1st April,2009 can exercise the option for New Pension Scheme explicitly meaning that those who joined on or after 01.01.2004 and before 01-04-2009 can continue to be under CPF Scheme.

Hence ,on behalf of all the staff of NVS, the Joined Action Committee comprising all the above service Associations bring the above matter to your kind notice that employees have decided not to opt for New Pension Scheme.

This is for your kind information and necessary action to impliment GPF Cum Pension Scheme to all the employees of NVS

VIDYALAYA SAMITI EMPLOYEES ASSOCIATIONS/FORUM HELD ON 01.10.2009 AT PHD CHAMBER OF COMMERCE AND INDUSTRIES, CHANDIGARH
.


Second Meeting of the Joint Action Committee consisting of All India Navodaya Vidyalaya Principals’ Forum, All India Navodaya Vidyalaya Staff Association, Navodaya Vidyalaya Samiti Employees Welfare Association and All India Catering Assistants Association was held on 01.10.2009 at PHD Chamber of Commerce and Industry, Sector 31-A, Chandigarh. Members from all the Regions of Navodaya Vidyalaya Samiti participated in the meeting. The following Agenda items were put up before the house for open and detailed discussions and for deciding the further course of action.

1. Review of the 5th September,2009(Hunger Work Day)
2. Strengthening of Joint Action Committee
3. Further Strategies for struggle for Pension and 10% Residential Allowance for Non-teaching staff.

The meeting started at 10.30AM and at the outset, Sh. C.M.Sharma, Principal, JNV Chandigarh(venue) and Vice President, Principals’ Forum Welcomed the gathering and set the ball rolling for discussions of the agenda. He requested the Presidents and General Secretaries of all the associations to share their views to set the Road Map to achieve the long pending legitimate demands of all the employees of Navodaya Vidyalaya Samiti.

Sh. V.L.Balasubramanian, Sh. T.P.Mani, Sh. Shiv Narain and Sh. S.S. Dora all Presidents and Sh. R.S. Naik, Sh. L.B. Reddy, Sh. J.K. Singh and Sh. Raj Kumar Radi all General Secretaries shared their views on the success of Hunger Work Day observed throughout the Navodaya Vidyalayas of the country on September 05th. They also proposed certain further course of actions required to be taken up immediately to pressurize the Management and the Government which has turned deaf ear till now for the genuine and long pending demands of the employees.

Many other members also spoke during the pre-lunch session and shared their concern about the step motherly treatment of the Government ignoring and disrespecting the sincere and Gandhian efforts, till now. They appreciated that atlast all the Associations have come on one Platform and this was the high time to channelise all the energies and move fast towards the goal/target. They stressed that certain tough steps are now required to be taken up to make the Government wakeup. The speakers observed that Hon’ble HRM has immediately responded when just 1400 Professors of IITs went for hunger striker but he was silent when more than 14000 employees of Navodaya Vidyalaya Samiti observed Hunger work day on Teachers’ Day. This speaks about the mind set of the Ministry of HRD towards the employees of Navodaya Vidyalaya Samiti. The prominent speakers from the JAC and the gathering were following:-

Various proposals were given by the speakers for stepping up the pressure on the government in the coming days. A Press Conference was held during the Lunch Session which was addressed by the Office Bearers. The Press was apprised about the long pending demand of Pension etc and steps taken till now and the future action plan. Thereafter, in the post-lunch session all the proposals given by the office bearers and the other members were analyzed and after detailed deliberations the following decisions were taken unanimously:

1.Mobilization for strengthening the JAC(26th October – 2nd November 2009): It was resolved that all the office bearers of all the Associations and the Executive Members of the JAC will move in Phased manner to all the States from 26th October – 2nd November 2009 to form State level units of JAC which may comprise members from all the Associations. The Convener of the State Level JAC will be one of the Principals of the State and after every ten vidylayas in the State there will be two Princpals(including the Convener), four teachers and two non-teaching staff and one Catering Assistant. The State Level JACs will ensure that the decisions taken in the 2nd Meeting of JAC reaches each and every member of all the vidyalayas in the state.

2.Wearing of Black Badges -2nd November – 7th November 2009: It was further resolved and decided that all the Staff Members of Navodaya Vidyalaya Samiti(Hqrs, ROs, NLIs, and JNVs) will put Black Badges w.e.f. 2nd November – 7th November 2009 and they will ensure that they carry these Badges wherever they go during this period so that the Public may know the reasons behind it. During this period all the Vidyalaya units will give press notes in this regard and ensure that the Media(Print and Electronic) gives due coverage.

3.Mass Rally at Delhi 9th November 2009: It was decided to hold a Mass Rally at Jantar Mantar, New Delhi at 9.00AM sharp wherein atleast 6000-7000 employees of JNVs from all over the country will join. For this minimum 12-15 members of the staff from each JNV, Regional Office/NLI and NVS Headquarters shall reach Delhi by the evening of 8th of November 2009. State Level Unit of JAC will mobalize the staff of the JNVs of the respective State to ensure that maximum employees reach the venue of Mass Rally. The expenditure on TA/DA of the members who shall visit Delhi will be born by the respective vidyalayas through collections from the staff. All Vidyalaya Units will carry a banner on white cloth/Flex in the size of 6’X3’ in which two sticks could be inserted on both ends so that two members could carry it holding from both the ends. The following should be got printed:-

Similarly, posters and banners carrying different slogans demanding pensions and 10% residential allowance for the Non teaching staff should also be got prepared at vidyalaya level and each member should carry atleast one poster/banner. The vidyalaya units may give suggestions for making all the activities of the JAC successful and also propose slogans etc which will be downloaded by vidyalaya units and got printed accordingly.

An organizing Committee for the Mass Rally at Delhi consisting of the following members was constituted to make all suitable arrangements for the success of the Rally:-

The Members of the organizing committee will reach New Delhi by 7th of November 2009 evening and make arrangements for packed lunch and water bottle etc. for the members attending the rally. The expenditure will be borne by all the Associations equally.

4.One day Token Strike: 16th November 2009(MONDAY) The JAC after detailed discussions and deliberations decided to go for one day Token Strike on 16th November 2009 through out all the JNVs.,ROs,NLIs and Headquarters of NVS. For this a Notice will be issued to the Chairman/HRM, Commissioner NVS and Chairman of the Vidyalaya Management Committees by the JAC by 06.10.2009. For this the parents will be taken into confidence by way of holding the PTC meetings on the Ist Saturday in November 2009 and they will be apprised of the difficulties likely to be faced by the students on 16th November 2009. The parents will be informed about the step motherly treatment being meted out to the NVS employees and seek their full cooperation on the day of TOKEN STRIKE.

On the day of token strike the whole staff of the Navodaya Vidyalayas (Principals, Teaching and Non Teaching including Mess Staff) will be on complete strike and the whole system will be paralyzed. No activity will take place. 3 to 5 of the Staff of the vidyalayas will move to the respective Regional Offices a day before and will organize a Mass Dharna infront of Regional Office from 9.00am to 2.00PM. Thereafter, they will move towards the Governor House in Procession and handover a Memorandum to H.E. The Governor of the State. Similarly, atleast 10members from each Regional Office, will move to New Delhi to stage a Dharna infront of Hqrs alongwith the staff from the said office. Vidyalaya units will also stage a Dharna in front of the main gate of the Vidyalaya from 9.00 am to 2.00pm and thereafter move to the District Hqrs to hand over a Memorandum to the Deputy Commissioner/District Magistrate. Similar Memorandums will be handed over to the Member of Parliaments on the same day. A draft Memorandum will be available on the web site/blog which will be downloaded and signed by the respective representatives of the Vidyalaya units and handed over to the DC/DM and MPs.

Signing the option forms for NPS 2004 The issue regarding signing the option forms for opting New Pension Scheme circulated by NVS also came up for discussions. It was unanimously decided that no employee will sign the option because neither the employees working before 1.1.2004 are ready to accept the New Pension Scheme nor the employees who have joined after 1.1.2004 are being benefited because the Samiti has distorted the scheme by effecting it w.e.f. 01.09.2009. Therefore, no staff member will sign the options and even those who have earlier signed will send a letter withdrawing it. The JAC will also convey its decision in this regard to the Management immediately in writing.

KOTTAYAM: More than 20,000 employees, both teaching and non-teaching, of Jawahar Navodaya Vidyalaya (JNV) and Navodaya Vidyalya Samiti across the country, will observe a ‘Hunger Working Day’ on Teachers’ Day, Saturday.
Speaking to The Hindu over the telephone for the Joint Action Committee (JAC) of the employees, V. L. Balasubramanian, principal, JNV, Kasaragod, said they have decided to observe the Teachers’ Day as a protest day as the authorities have failed to give them the GPF- cum- Pension Scheme, in spite of repeated demands during the past two decades or more. “Out of the more than 20,000 employees, 14,225 had joined the organization prior to January 1, 2004 and are eligible for GPF-cum-Pension Scheme,” said Mr. Balasubramanian.
On an average there are 560 students in each of the 576 JNVs spread across the country.
The routine of these schools will not be affected in any way on Saturday, he said.
Institutions of similar nature, like National Open School, Kendriya Vidyalayas, Sainik Schools and Tibetan Central Schools have been granted GPF-cum-Pension Scheme, he said and added that even institutions like the Konkan Railways, IITs, IIMs and Punjab University have granted GPF-cum-Pension scheme to their employees who have joined prior to January 1, 2004.
Reports of various Department Related Standing Committees on HRD have also strongly recommended extension of pensionary benefits as has been done to Kendriya Vidyalayas.
Moreover, the MHRD had on many occasions written to the Navodaya Vidyalaya Samiti to implement GPF-cum-Pension Scheme to its employees.
“The employees are now suffering for the omissions of the then administrators of the NVS,’ Mr. Balasubramanian said. Presently, they have taken steps to bring the employees under the New Pension Scheme which is an injustice to the large majority of employees who are rightfully eligible for GPF-cum-Pension Scheme, he added.
